Terms & Conditions

Class of Choice is an online tutoring service provider based in Dubai, UAE. COC provides live classes in language, academic, coding and hobby courses. These Terms and Conditions ('Agreement') form the contract between COC ('we' or 'us' or 'our') and the Parents or any persons ('you' or 'client') who engage the Service of The Tuition Pod on behalf of their son/daughter/dependant ('your child').

1. definitions

“Courses” means educational courses listed on the Site or Application;

“Course Fees” means the amounts that are due and payable by a Student for enrolment of Course;

“Tuition” means Hourly Online Tuition as agreed as appropriate;

“Tutor” means the person who is registered with Class of Choice to provide educational tutoring services and who accepts to undertake the service;

“One-to-one Tutoring” means a ratio of 1 child to 1 tutor per session;

“Group Tutoring” means a maximum ratio of 2 to 6 children to 1 tutor per session;

“Hours” means the number of Tuition hours discussed/set out in the Confirmation Correspondence;

“Service” means the course of Tuition/Course as set out and agreed in the Confirmation Correspondence;

“Free demo” means half an hour free session, allowing Students and Tutors to get to know each other for better delivering of Tutoring Services;

“COC” Class of Choice

2. general

These Terms and Conditions contain the entire agreement (“Agreement”) between us and you and supersede any prior agreement between us relating to their subject matter. Nothing in this clause shall limit or exclude any liability for fraud.

These Terms and Conditions shall apply (and be deemed to be accepted by you) from the date in which you instruct Class of Choice to complete an Assessment or begin any form of tuition mentioned in the Definitions on Page 1. Unless otherwise agreed in writing by a Director of COC, these Terms and Conditions shall prevail over any other terms of business or conditions put forward by you.

To the extent that the Tutor is engaged by COC as a self-employed Tutor nothing contained within this Agreement shall constitute the relationship of employer and employee and/or worker or a partnership between COC and the Tutor, or between you and the Tutor.

If you do not agree to these Terms, then you have no right to access or use the Site, Application, Services, or Collective Content .If you are using the Site, Application or Services then these Terms of Service are binding between you and COC

3. our obligations

For each Service Class of Choice will:

ask you to confirm certain information during the conversation, which will be your initial phone call to COC;

carry out an Assessment to enable Class of Choice to provide recommendations for ensuring the most suitable services;

once you we have received the confirmation as to the Service you require we will assign the Tutor to provide the Live Tuition during the relevant Hours; and from the relevant Service Start Date until the earlier of the Service End Date (if any) and/or the date on which the Service is terminated in accordance with these Terms and Conditions and/or the relevant notice period (if any) discussed/set out in the Confirmation Correspondence.

You are obliged to pay us any fee that falls due in accordance with clause 5 of these Terms and Conditions.

4. your obligations

You shall:

co-operate with Class of Choice in all matters relating to the Service;

provide Class of Choice with such information and materials as may reasonably be required in order to supply the Service and ensure that such information is accurate in all material respects;

comply with the payment terms of each material invoice;

ensure you/your child is aware of the high behavioural expectations during sessions to receive maximum benefit from Tutoring.

5. fees and payments

A fee will be incurred on the completion of the Registration. This fee is applicable regardless of whether a further Service is booked. Students should pay the fees in advance before 10th of every month.

Upon the selection of a Service you will incur a Fee. This clause sets out how the Fee will be calculated and when the Fee will be payable. The amount and type of Fees applicable to a Service will be confirmed to you at the time of Registration.

The Class of Choice imposes different payment terms depending on the Service selected by you and as listed in the classofchoice.com website.

6. cancellation, replacement tutors and rearranging lessons

Cancelling a Service - please ensure that you agree on the arrangements for each lesson. If you need to cancel or change a lesson, please call us directly and send a confirmation email to km.kalyani@gmail.com at least two hours before the set appointment time In the event that a Tutor wishes to cancel a Session, the Tutor/Classs of Choice will notify the Student at least two hours before the set appointment time

Rearranging lessons - both you and the Tutor must give reasonable notice to each other of any holiday commitments you may have or any changes to the tuition timetable necessary because of illness. If you cannot make your lesson please note that your lesson is non-transferable and non-refundable due to timetabling restrictions and constraints. If Class of Choice are unable to deliver your scheduled lesson you will be entitled to a full refund, or provided with an alternative lesson time agreeable to you.

Replacement of tutors -in the event that your usual tutor is unavailable, Class of Choice may provide an alternative Tutor to deliver the lesson(s). If this happens, Class of Choice will advise you in advance, either in person or in writing, and you will have the option to accept this substitution or receive a refund. There will be a full consultation between the usual Tutor and the replacement Tutor prior to the lesson, to ensure continuity of learning.

7. refund policy

You can only ask for a refund only, when the Tutor was not available at the scheduled time of live classes or could not complete the Tutoring Session for any reason. No compensation will be obtained for classes missed by students except for some crucial reasons.

However, in case of Tutor's absent from the Platform during the set appointment time or in case of in-completion of Tutoring Session by the Tutor, the Student will be entitled to a refund unless Tutor asks Student to set another appointment time for the Session and Student agrees for the same. This way both parties can resolve the issue internally without going into any complaint procedure, but the next Tutoring Session must be scheduled within the next 7 days.

You can ask for a refund of fee within 72 hours of such Tutoring Session you are claiming about. You will just need to provide details of the session and Immediate credit back will be given. Our administrators will track such students and review sessions.

8. restrictions on the use of site contents

Class of Choice grants you a limited, personal, non-exclusive, non-commercial, revocable and non-transferable license to view the Content available on classofchoice.com. You may only use the Services for your own personal use. You agree not to view, copy, or procure content or information from the Services by automated means (such as scripts, bots, spiders, crawlers, or scrapers), or to use other data mining technology or processes to frame, mask, extract data or other materials from the Class of Choice Content unless formally authorized by C0C under separate written agreement.

As discussed above, no materials from the Services may be copied, reproduced, modified, republished, downloaded, uploaded, posted, transmitted, or distributed in any form or by any means without Our prior written permission or as expressly provided in these Terms of Services. When you download or use the COC Content as authorized by these Terms of Services, you must:

Keep intact all copyright and other proprietary notices;

Make no modifications to the COC Content; and You are not authorized to use the Services of COC if you are previously registered and closed by Class of Choice;

Not copy or adapt any object code associated with the Services or reverse engineer, modify or attempt to discover any source code associated with the Services, nor allow or assist any third party (whether or not for your benefit) to do so;

Restriction on the Use of Site Content.

9. service modifications

Class of Choice reserves the right to change, supplement, discontinue or update any of its Service at any time. COC may also change or impose fees for Services provided through the Website at any time in its sole discretion. COC may establish or change, at any time, general practices and limits concerning other its Services in its sole discretion. As we continuously update our Services; therefore, we accept no liability if these changes are not immediately reflected in the Terms and Conditions.

10. tutors at coc

All of the Tutors we take on board have to go through various quality checks but their inclusion in our Tutors list. They are suitable and qualified to provide the live classes which they provide through our platform.

11. service disclaimer

Use of the site is at your sole risk unless otherwise explicitly stated. the website does not make any warranty or representations that:

The site will be uninterrupted, timely, secure, or fault less;

The results that may be obtained from the use of the website will be accurate or reliable;

The quality of any products, services, content, information, or other material purchased or obtained from tutors will meet your expectations or requirements; or

Any errors in the site will be corrected;

You assume all risk for any damage to your computer system or loss of data that results from obtaining any content from the site, including any damages resulting from computer viruses. the site does not have any kind of liability in case of such issues

12. third party content/links

You agree to indemnify and hold COC and each of its respective shareholders, directors, officers, employees, Moderators, Mentors, agents and partners harmless from and against any third-party claim or cause of action, including reasonable attorneys’ fees and court costs, arising, directly or indirectly, out of your breach of these Terms of Service and/or your violation of any law or the rights of any third party.
